Trusts form the cornerstone of many business structures, and disputes connected to a atrimonial split, estate disputes and family
disputes all put trust deeds to the test, with the judiciary ultimately casting its judgment. Using real world examples, this article considers strategies in conflicts of this nature that, together with the Bankruptcy Act, can make the corporate veil look like nothing more than a flimsy piece of material. Also considered is the adviser’s role in dealing with some of these issues before they become
issues by providing suggestions that can be easily applied to a client’s circumstance.
